LIFT Privacy Policy

This website (the “Site”) is operated by Leadership in Flight Training Academy LLC and LIFT Maintenance (collectively “LIFT”), 2753 Cargo Dr., Indianapolis, Indiana 46241, United States. References to “LIFT”, “we”, “us”, or “our” are references to LIFT.

This policy (“Privacy Policy”) applies to personal information about customers, potential customers, employees, potential employees, students, potential students, suppliers, prospective suppliers, business contacts, Site users, and all other persons about whom LIFT processes personal information. This Privacy Policy explains what types of personal information we collect and how we treat that information, as well as your rights with respect to your personal information, how to exercise those rights, and who to contact for more information.

Residents of certain countries and U.S. states, including California, have additional rights with respect to the collection, use, and disclosure of their personal information. Residents of those countries and U.S. states can learn more via the additional disclosures applicable to them:

We do update this Privacy Policy from time to time. Any changes we make to our Privacy Policy in the future will be posted on this page with the date of the most recent update and, where appropriate or required by law, notified to you on the Site or by email.

Information we collect

We collect and process various categories of personal information from you for the purposes detailed in the “Use of your information” section, below.

The categories of personal information we collect include:

  1. Identifiers, such as name, alias, postal address, unique personal identifier, online identifiers, Internet Protocol address, email address, signatures, physical characteristics or description, telephone number, or other similar identifiers.
  2. Financial Information, including bank account number, or any other financial information that does not allow access or withdrawal of funds.
  3. Characteristics of Protected Classifications under state or federal law, such as age, gender, and marital status.
  4. Commercial Information, such as records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.
  5. Biometric Information.
  6. Internet or Other Network Information, such as browsing history, search history, cookie data, and other information regarding your interactions with our websites or advertisements.
  7. Geolocation Data, such as device location that is more granular than a city or town.
  8. Audio, Electronic, Visual and Similar Information, such as call and video recordings.
  9. Professional or Employment-Related Information, such as work history and prior employer.
  10. Education Information, as defined in the federal Family Educational Rights and Privacy Act, such as student records and directory information.
  11. Sensitive Personal Information, including:
    • a. Personal Information that reveals your:
      • i. Social security, driver’s license, state identification card, or passport number;
      • ii. Account log-in, or financial account number;
      • iii. Precise geolocation that is used or intended to be used to locate you within a small geographic area (less than a radius of 1,850 feet); or
      • iv. Racial or ethnic origin, or union membership.
    • b. Personal Information collected and analyzed concerning your health.

We collect the above categories of information from a variety of sources. Specifically, we collect personal information from (1) you, when you communicate with us by any means, including information about you that you give us by filling in forms on our Site or by corresponding with us by phone, email or otherwise, (2) from our vendors and from third parties when they provide personal information to us, (3) from public databases, providers of demographic data, publications, professional organizations, and social media platforms, and (4) from cookies and other online identifiers automatically when you use our Site.

Please note that the categories of personal information we collect from you will vary based on your relationship with LIFT. For example, if you are an employee or job applicant, we will collect personal information from and about you related to your employment (such as background check information, financial details for payment processing, performance evaluations, etc.). By contrast, if you are a website visitor, we will collect more limited personal information from you (such as your IP address, your use of our Site, and any information you provide to us if you contact us with questions).

Use of your information

We use your personal information to:

  • Operate, manage, and maintain our business
  • Provide you with a safe, smooth, efficient, and customized experience on our Site
  • Provide our products and services to you
  • Personalize, advertise, and market our products and services
  • Provide information to you that you request from us relating to our products or services and to communicate with you
  • Inform you of any changes to our Site, services, or goods and products
  • Administer our Site and for internal operations, including troubleshooting, data analysis, testing, research, statistical, and survey purposes
  • Process employment applications, maintain employment records, and manage our workforce
  • Comply with our legal obligations
  • Enforce our policies, exercise our rights, and protect our property

Cross-border transfers of your information

Processing of your personal information may, on occasion, include cross-border international transfer of data for processing purposes. LIFT takes commercially reasonable and customary measures to appropriately protect your personal information, such as through the use of Standard Contractual Clauses approved by the EU Commission or similar contractual clauses in other jurisdictions, or through other appropriate safeguards.

Storing and protecting your personal information

We will only keep the information we collect about you, through your use of the Site or otherwise, for as long as required for the purposes set out above or as required to comply with any legal obligations to which we are subject. This will involve us regularly reviewing our files to check that information is accurate, up-to-date and still required.

We also implement technical, physical, electronic, and administrative safeguards to protect your information from unauthorized access and acquisition. Unfortunately, the storing of information and the sending of information via the internet (including by email) is not totally secure and on occasion such information can be intercepted. Although we implement measures to protect your personal information, we cannot guarantee the security of information that you choose to send us electronically, and sending such information is entirely at your own risk.

Disclosing your information

We disclose personal information we collect to the following categories of entities for the purposes listed above in the “Use of your information” section:

  • Other entities within our corporate family, including Republic Airways Inc. and other subsidiaries of Republic Airways Holdings Inc.;
  • Our vendors, including our web hosting provider, web analytics services, LIFT Academy financing and housing providers, information technology providers, and communications providers;
  • Law enforcement agencies, other governmental agencies or third parties if we are required by law to do so, or in other limited circumstances (for example if required by a court order or regulatory authority, or if we believe that such action is necessary to prevent fraud or cyber-crime or to protect the Site, our technology assets, or the rights, property, or personal safety of any person); and
  • Other business entities if we are involved in a merger, acquisition, joint venture, cooperative research initiative, strategic alliance, supply relationship, financing due diligence, reorganization, bankruptcy, receivership, sale of all or a portion of our assets, or transition of service to another provider (collectively a “Transaction”); your personal information and other information may be shared in the diligence process with counterparties and others assisting with the Transaction and transferred to a successor or affiliate as part of that Transaction along with other assets.

On occasion, we include links to third parties on this Site. Where we provide a link, it does not mean that we endorse or approve that site’s policy towards visitor privacy. This Privacy Policy relates only to information contained on, or gathered via, this Site and does not apply to any third party site. You should review any third party’s terms and conditions, information security practices, and any applicable privacy policy before disclosing any personal information to a third party.

Children’s Privacy

No parts of our Site are intended to be utilized by, directed toward, or designed to attract anyone under the age of eighteen. By proceeding to use this Site, you are confirming that you are at least eighteen years of age. We do not knowingly collect or maintain personal information from any person under the age of eighteen. If we learn that we have collected or received personal information from a child under eighteen without verification of parental consent, we will delete that information. ADDITIONAL INFORMATION FOR EEA/UK DATA SUBJECTS

Introduction

This section applies to individuals in the European Economic Area (“EEA”) and the United Kingdom (“UK”), in addition to the terms set out above, to the extent such individuals’ data is protected by the Data Protection Legislation. In this section “Data Protection Legislation” means the EU General Data Protection Regulation 2016/679 (“GDPR”), applicable national legislation implementing the GDPR, and the UK GDPR. Where we use the terms “data subject”, “controller”, “processor”, “process” (and its derivatives), and other terms defined by the Data Protection Legislation, such terms shall have the meanings given to them in the Data Protection Legislation. Further, references to “personal information” in this section shall have the same meaning as “personal data” as defined in the Data Protection Legislation.

Who are we?


LIFT is the data controller for the purpose of the Data Protection Legislation and is responsible for processing your personal information under this Privacy Policy, unless otherwise notified to you in connection with a particular product or service.

Legal bases for using your personal information

Our processing of your personal information is necessary:

  • for the performance of contracts to which you will be a party to and in order to take steps at your request prior to you entering into those contracts, including to provide you with products or information you have requested;
  • for our legitimate interests or those of third parties described below; or
  • in order to comply with a legal obligation to which we are subject.

In relation to any processing of special categories of personal information, we will generally rely on obtaining specific consent from you at the time of collection unless there is otherwise a legal requirement for us to process such information.

Legitimate interests

Where our processing is based on the legitimate interest grounds described above, those legitimate interests are: (i) regarding personal information we collect through our participation at trade shows, meetings or other events, to develop a relationship with you, including to follow up with you regarding an event or meeting, or send you information that you have requested on our company, employment, and services; (ii) to provide you with a smooth and efficient customer experience, including using strictly necessary cookies to operate and administer the Site; (iii) running our business, including to comply with legal obligations, respond to requests from competent authorities, protect our operations or those of any of our affiliated businesses, protect our rights, safety or property, and/or that of our affiliated businesses, you or others, and enforce or defend legal rights, or prevent damage; (iv) to provide the products and services you have requested; (v) to prevent fraud; and (vi) for our own marketing, research and development.

Transferring data outside of the EEA

LIFT is based in the United States (“U.S.”). If you are accessing our Site from the EEA, UK, or other regions with laws governing data collection and use, please note that any personal information that you provide to LIFT may be transferred to, processed, and stored in the U.S. in accordance with this Privacy Policy.

Where we share data with our affiliates, vendors, and third parties, your information may also be sent to and stored at, a destination outside the EEA or UK and may be processed by staff operating outside the EEA or UK who work for us, or for one of our affiliates, vendors, or third parties.

The U.S. and other countries to which your personal information may be transferred may have data protection laws less stringent than or otherwise different from the laws in effect in the country in which you are located. Where we transfer your personal information outside the EEA or UK, we will take reasonable steps with our receiving party to ensure that your personal information receives adequate security protection where it is processed, and your rights continue to be protected pursuant to the applicable Data Protection Legislation. Your rights in relation to your information

In accordance with Data Protection Legislation, at any time you have the right:

  • To request access to or a copy of any personal information which we hold about you;
  • To ask us to rectify your personal information, if you consider that it is inaccurate, or delete it, if you consider that we do not have the right to hold it;
  • To withdraw consent to our processing of your personal information (to the extent such processing is based on previously obtained consent);
  • To data portability (moving some of your personal information elsewhere) in certain circumstances;
  • To restrict processing of your personal information or object to your personal information being processed in certain circumstances, including if we are relying on a legitimate interest to process your personal information; and
  • To not be subject to a decision solely based on automated processing.

We will correct any incorrect or incomplete information and will stop processing your personal information, or erase it, where there is no legal reason for us to continue to hold or use that information. Further, we do not use automated processing, including profiling, to make decisions with legal or similarly significant effects. In general, you are not required to provide your personal information to us in order to use our Site. However, we may not be able to provide certain services to you, consider your application for employment, or hire you as an employee if you decline to provide certain personal information to us. If you have any concerns about our use of your information, you also have the right to make a complaint to the relevant European (or, as applicable, UK) Data Protection Authority that regulates and supervises the use of personal information in the EEA/UK.

ADDITIONAL INFORMATION FOR CERTAIN U.S. RESIDENTS

This section provides additional information for residents of U.S. states with comprehensive privacy legislation that requires provision of a privacy notice, including California, Colorado, Connecticut, Delaware, Indiana, Iowa, Montana, Oregon, Tennessee, Texas, Utah, and Virginia (collectively, “U.S. Privacy Laws”). Some portions of this section apply only to residents of particular states. In those instances, we have indicated that such language applies only to those residents.

Definitions

The below terms, whether or not capitalized, have the meanings set out below as used in this section.

  • “Personal information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. Personal information also includes the categories of “sensitive personal information” listed in the “Information we collect” section above.
  • “Sell,” “Sale,” or “Sold” means renting, releasing, or transferring an individual’s personal information to a third party for money or other valuable consideration.
  • “Share,” “Shared,” or “Sharing” means transferring an individual’s personal information to a third party for cross-context behavioral advertising or targeted advertising purposes, whether or not for money or other valuable consideration.
  • “Third Party” means any non-affiliated person that is not a vendor.
  • “Vendor” means a service provider, contractor, or processor that collects, stores, or otherwise handles data for us and is bound by contractual obligations to use your personal information only as directed by us.

You may be familiar with different terms that are used to describe materially similar concepts in this section by the U.S. Privacy Laws in your state of residence. You can treat them as the same for the purpose of this Privacy Policy. For example, we intend the term “Personal Information” here to have the same definition as “Personal Data” used in specific U.S. Privacy Laws.

Personal Information Collection and Disclosure

We, and our vendors, collect and have collected in the past 12 months the categories of personal information listed in the “Information we collect” section above. We collect these categories of personal information from the sources described in the “Information we collect” section above.

We, and our vendors, collect, process, and disclose these categories of personal information (excluding sensitive personal information) for the business and commercial purposes described in the “Use of your information” section above. We disclose and have disclosed for a business purpose in the past 12 months all of the categories of personal information in the “Information we collect” section above to the entities listed in the “Disclosing your information” section above.

Sensitive Personal Information

We, and our vendors, collect and process the sensitive personal information described in the “Information we collect” section above only for:

  • Performing the services or providing the goods reasonably expected by an average consumer who requests those goods or services;
  • Preventing, detecting, and investigating security incidents that compromise the availability, authenticity, integrity, or confidentiality of stored or transmitted personal information;
  • Resisting malicious, deceptive, fraudulent, or illegal actions directed at us and prosecuting those responsible for those actions;
  • Ensuring the physical safety of natural persons;
  • Short-term, transient use, including, but not limited to, non-personalized advertising shown as part of your current interaction with us, provided that we will not disclose your personal information to a third party and will not build a profile about you or otherwise alter your experience outside of your current interaction with us;
  • Performing services on our behalf, including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing financing, providing analytic services, providing storage, or providing similar services on our behalf;
  • Verifying or maintaining the quality or safety of a product, service, or device that is owned, manufactured, manufactured for, or controlled by us, and improving, upgrading, or enhancing the service or device that is owned, manufactured by, manufactured for, or controlled by us; and
  • Collecting or processing sensitive personal information where such collection or processing is not for the purpose of inferring characteristics about a consumer.

Sale, Sharing, Targeted Advertising, & Profiling

We sell and share internet and other network information, such as browsing history, search history, cookie data, and other information regarding your interactions with our websites or advertisements, and we have sold and shared such personal information in the past twelve months. We also process internet and other network information for purposes of targeted advertising. We sell, share, and process for purposes of targeted advertising internet and other network information to marketing and analytics providers to personalize, advertise, and market our products and services. Consumers have the right to opt out of the sale and sharing of their personal information and can do so by clicking the “Your Privacy Choices” link in the footer of our websites and then clicking “Reject All”.

We do not process personal information for purposes of profiling in furtherance of decisions that produce legal or similarly significant effects (which means a decision that results in the provision or denial of financial or lending services, housing, insurance, education enrollment or opportunity, criminal justice, employment opportunities, health-care services, or access to essential goods or services). Further, we do not have actual knowledge that we sell or share personal information of California consumers under 16 years of age.

Retention of Personal Information

We retain your personal information as described in the “Storing and protecting your personal information” section of our Privacy Policy.

Data Subject Rights

Residents who reside in states with U.S. Privacy Laws have the following rights regarding our collection and use of the Personal Information, subject to certain exceptions. Please read this section carefully as some rights vary by state.

  • Exercising Your Rights. You may exercise the right to opt-out of sales or sharing of your personal information or processing of your personal information for purposes of targeted advertising by clicking the “Your Privacy Choices” link in the footer of our websites and then clicking “Reject All.” You may exercise the other data subject rights below by calling us at +1 (844) 565-5546, emailing us at privacy@flywithlift.com, or by clicking here and submitting details regarding your request. Residents of certain states are permitted by law to authorize an agent to submit data subject requests on their behalf. If that applies to you, you may authorize an agent to submit data subject requests to us on your behalf. In such instances, authorized agents may use the same methods as you to submit the requests on your behalf. To verify your identity and protect your Personal Information, we may ask the requestor to provide information that will enable us to verify your identity in order to comply with your data subject request, such as asking your agent to provide proof of signed permission from you, or ask you to confirm with us directly that you provided the agent with permission to submit the request. In some instances, we may decline to honor your request if an exception applies under applicable law. We will respond to your request consistent with applicable law.
  • California Residents:
    • Right to Know: You have the right to know the following details about our privacy practices at or before the point of collection. We have provided such information in this Privacy Policy. You may also request that we provide you with information about the following aspects of how we have handled your personal information:
      • The categories of personal information we have collected about you;
      • The categories of sources from which we collected such personal information;
      • The business or commercial purpose for collecting, selling, or sharing personal information about you;
      • The categories of third parties to whom we disclose personal information; and
      • Specific pieces of personal information we have collected about you.
    • Right to Deletion: You may request that we delete any personal information about you we that we collected from you.
    • Right to Correction: You may request that we correct any inaccurate personal information we maintain about you. Please note this right does not apply to Iowa and Utah residents.
    • Rights to Opt-Out of the Sale and Sharing of Your Personal Information and to Limit the Use of Your Sensitive Personal Information: You have the right to opt-out of the sale and sharing of your personal information. You also have the right to limit the use of your sensitive personal information to the purposes authorized by the CCPA. However, please note that we do not use or disclose sensitive personal information for purposes beyond those authorized by the CCPA.
  • Colorado Residents: Under the Colorado Privacy Act, you have rights of access, correction, deletion, data portability, and rights to opt out of sales and targeted advertising. You also have the right to opt out of profiling in furtherance of decisions that produce legal or similarly significant effects. However, as noted elsewhere in this Privacy Policy, we do not profile in furtherance of decisions that produce legal or similarly significant effects.
  • Other U.S. Residents: Residents of other U.S. states with U.S. Privacy Laws have similar data subject rights to those listed above for California and Colorado residents. Most U.S. Privacy Laws provide residents of their states with rights to access, correct, and delete their personal information, subject to certain exceptions. You may also have the right under the U.S. Privacy Law applicable to you to opt out of targeted advertising, sale of personal information, and/or profiling in furtherance of decisions that produce legal or similarly significant effects. However, as noted elsewhere in this Privacy Policy, we do not profile in furtherance of decisions that produce legal or similarly significant effects.
  • Opt-Out Preference Signals. We recognize opt-out preference signals that we are required to recognize for compliance with applicable law. Where required by U.S. Privacy Laws, we treat such opt-out preference signals as a valid request to opt-out of sale, sharing, and processing for purposes of targeted advertising, as applicable, for the browser or device through which the signal is sent and any consumer profile we have associated with that browser or device, including pseudonymous profiles. Further, if we know the identity of the consumer from the opt-out preference signal, we will also treat the opt-out preference signal as a valid request to opt out of sale and sharing for such consumer. Consumers may use opt-out preference signals by downloading or otherwise activating them for use on supported browsers and setting them to send opt-out preference signals to websites they visit.
  • Non-Discrimination. We will not discriminate against you for exercising your data subject rights. For example, we will not deny goods or services to you, charge you different prices or rates, or provide a different level of quality for products or services as a result of you exercising your data subject rights.
  • Appeals. Residents of certain states have the right to appeal our decisions on their data subject requests. This section does not apply to California or Utah residents, or to residents who reside in other states where the applicable U.S. Privacy Law does not give them the right to appeal controllers’ decisions regarding data subject rights. Please enclose a copy of or otherwise specifically reference our decision on your data subject request, so that we may adequately address your appeal. We will respond to your appeal in accordance with applicable law.

Other Disclosures:

  • California Residents Under Age 18. If you are under the age of 18 and a registered user of our website, you may ask us to remove content or data that you have posted to the website by writing to privacy@flywithlift.com. Please note that your request does not ensure complete or comprehensive removal of the content or data as, for example, some of your content or data may have been reposted by another user.
  • Disclosure About Direct Marketing for California Residents. California Civil Code § 1798.83 permits California residents to annually request certain information regarding our disclosure of personal information to other entities for their direct marketing purposes in the preceding calendar year. To make such a request, please send an email to privacy@flywithlift.com with the subject “Shine the Light Request.”
  • Financial Incentives for California Residents. We do not provide financial incentives to California residents who allow us to collect, retain, sell, or share their personal information. We will describe such programs to you if and when we offer them to you.
  • Disclosure for Nevada Residents. We sell “Covered Information” as defined under Nevada law, but we generally do not disclose or share “Personal Information” as defined under Nevada law for commercial purposes. Under Nevada law, you have the right to direct us to not sell your Covered Information to third parties, as defined under Nevada law.
